Terms and Conditions of Sale

Article 1 — General Provisions
These Terms and Conditions of Sale (hereinafter "T&Cs") govern all transactions made on the website https://www.pierregasly.com/ operated by Pierre Gasly Trading SAS (hereinafter the "Operator"). Placing an order on the Website implies full and unconditional acceptance of these T&Cs, which take precedence over any other document.
The T&Cs are permanently available on the Website and may be provided to the customer upon request.
Article 2 — Products
The Website offers for sale official Pierre Gasly merchandise: clothing, accessories, collectibles, helmet replicas and other merchandising items (hereinafter "Products").
The essential characteristics of each Product are described on its product page. Photographs are as accurate as possible but are not contractually binding. The Operator undertakes to sell only products compliant with applicable French and European regulations.
Article 3 — Orders
The Operator endeavours to ensure product availability within the limits of existing stock. In the event of unavailability after an order is placed, the customer will be informed by email as soon as possible and may choose between:
- A replacement product of equivalent quality and price.
- A full refund within a maximum of 30 days.
Orders are firm and final, subject to the right of withdrawal set out in Article 8.
Article 4 — Prices and Payment
Prices are quoted in euros (€) inclusive of all applicable taxes (VAT), excluding delivery charges. The Operator reserves the right to modify prices at any time; products are invoiced at the price in force at the time the order is confirmed.
Accepted payment methods are indicated on the Website at checkout. Full payment is due upon order confirmation.
The Operator reserves the right to verify the authenticity of payment before dispatch.
Article 5 — Contract Formation
The contract is formed through a "double-click" process: the customer selects their products, reviews their cart, accepts these T&Cs and completes payment. This validation constitutes an electronic signature with the same legal value as a handwritten signature.
An order confirmation email is sent to the customer upon validation. The Operator retains records of orders and invoices as proof of contract.
Article 6 — Retention of Title
The Operator retains ownership of the Products until full payment of the price, including any delivery charges, has been received.
Article 7 — Delivery
Deliveries are made to metropolitan France, European Union member states and internationally. The Operator undertakes to dispatch Products within a maximum of 30 days of receiving the order, unless otherwise stated on the product page.
Indicative delivery times are as follows:
- Metropolitan France: 2 to 3 business days.
- Europe: 3 to 7 business days.
- International (outside EU): 7 to 15 business days.
A confirmation email including the parcel tracking number is sent to the customer upon dispatch. Tracking is also available from the "My Account" section on the Website.
The customer must check the condition of the parcel upon delivery and note any anomaly on the delivery note. No claim regarding the apparent condition of the Product will be accepted after signing the delivery note without reservations.
The Operator shall not be liable for delays caused by the carrier or by an incorrect delivery address provided by the customer.
Article 8 — Right of Withdrawal
In accordance with Articles L.221-18 et seq. of the French Consumer Code, the customer has fourteen (14) calendar days from receipt of the Products to exercise their right of withdrawal, without having to provide justification or pay any penalties.
To exercise this right, the customer must notify Pierre Gasly Trading SAS by email at contact@pierregaslyshop.com or by post to the registered office, using the withdrawal form below or any other unambiguous statement.

Return shipping costs are borne by the customer, except in the case of a defective product or a dispatch error attributable to the Operator.
The refund will be processed within 14 days of receipt of the returned Product, using the same payment method as the original order.
Products that have been unsealed by the customer after delivery for hygiene reasons, personalised products, and all other exceptions listed under Article L.221-28 of the French Consumer Code are not eligible for return.
Article 9 — Legal Guarantees
9.1 Legal Guarantee of Conformity
The customer benefits from the legal guarantee of conformity (Articles L.217-4 et seq. of the French Consumer Code) for two (2) years from delivery of the Product. The customer may choose between repair or replacement of the Product. For the first 24 months, the customer is not required to prove the existence of a lack of conformity.
9.2 Guarantee Against Hidden Defects
The customer also benefits from the guarantee against hidden defects (Articles 1641 to 1648 of the French Civil Code) and may choose between rescission of the sale or a reduction in price in accordance with Article 1644. The action must be brought within two years of the discovery of the defect.
9.3 Returns Procedure
All returns must be preceded by a request submitted to contact@pierregaslyshop.com. The customer will receive return instructions by email. Products must be returned in their original packaging, complete, with the purchase invoice. Incomplete, damaged or unpackaged Products will not be accepted, except in cases of hidden defects.

Article 11 — Intellectual Property
The Operator is the sole owner of all elements on the Website (texts, images, logos, trademarks, databases). Any unauthorised reproduction or use is prohibited and constitutes an infringement.
Article 12 — Personal Data

Article 13 — Liability
The Operator's liability may only be engaged in the event of proven fault and shall not cover indirect damages. The Operator is not liable for delays or non-performance due to force majeure events or acts attributable to the customer or a third party.
Article 14 — Mediation and Dispute Resolution
In the event of a dispute, the customer is invited to contact customer service first at contact@pierregaslyshop.com.
If no response is received within 10 days or the complaint is unsuccessful, the customer may refer the matter to the designated mediator:

Article 15 — Governing Law
These T&Cs are governed by French law. Any dispute shall be submitted to the competent courts of the jurisdiction of the registered office of Pierre Gasly Trading SAS.
